Terms of Service

1Agreement
These Terms of Service govern your use of Bleue AI services operated by Zolis Web Design (“we,” “us,” or “Bleue AI”), located in Riverside, CA. By signing a service agreement, making a payment, or using our platform, you agree to be bound by these Terms. If you do not agree, do not use our services.
2Services
Bleue AI provides AI-powered business automation including lead capture and qualification, automated follow-up sequences, inbound call and message handling, document processing, review management, and performance reporting.
The specific services provided are defined in your service agreement and correspond to the tier selected (Core Fleet or Full Fleet).

4Client Responsibilities
You agree to:
- ✓ Provide accurate business information needed to configure your AI agents
- ✓ Obtain all necessary consents from your customers before we send communications on your behalf (email, SMS, calls)
- ✓ Comply with all applicable laws including CAN-SPAM, TCPA, GDPR, and CCPA as applicable to your jurisdiction and industry
- ✓ Not use our services to send spam, harass individuals, or violate any law
- ✓ Keep your login credentials and API keys confidential
5AI Disclosure & Accuracy
You acknowledge that:
- — AI-generated responses may occasionally be inaccurate and may require human review
- — You are responsible for reviewing AI actions that carry legal or financial consequences
- — Our AI agents will disclose their AI nature to your customers when directly asked
- — We are not liable for decisions your customers make based on AI-generated responses
6Results Guarantee
If you are not seeing measurable results within the first 90 days of active use, we will continue working with you at no additional charge to diagnose and fix the issue. This guarantee applies when you have followed our onboarding recommendations and your agents have processed a minimum of 50 leads or interactions.
7Intellectual Property
Agent configurations, workflows, and automations we build are built on our proprietary platform. You receive a license to use the service during your active subscription. Upon cancellation, your business data can be exported in full. Our underlying platform, agent architecture, and system configurations remain our intellectual property.
8Confidentiality
Both parties agree to keep the other's confidential business information private. We will not share your business data, customer lists, or operational details with any third party without your written consent, except as required by law or to deliver our services (e.g., passing billing data to Stripe).
9Limitation of Liability
To the maximum extent permitted by law, Bleue AI's total liability for any claim arising from these Terms or our services is limited to the total fees paid by you in the three (3) months preceding the claim.
We are not liable for indirect, incidental, special, or consequential damages — including lost profits, lost data, or business interruption — even if we have been advised of the possibility of such damages.
10Termination
Either party may terminate after the minimum term with 30 days written notice sent to hello@bleue.ai. We reserve the right to suspend or terminate service immediately if you violate these Terms, engage in illegal activity, or fail to pay after the 7-day grace period. Upon termination, we will provide a data export within 14 days upon request.
11Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts of Riverside County, California. Both parties consent to personal jurisdiction in those courts.
12Changes to These Terms
We may update these Terms from time to time. We will notify active clients of material changes by email at least 14 days before they take effect. Continued use of our services after that date constitutes acceptance of the updated Terms.
